Skelly and Loy has conducted more than 200 government imposition claims evaluations since 2006, many in response to the national Mine Improvement and New Emergency Response (MINER) Act and more recently relating to Mine Safety and Health Administration (MSHA) regulations and orders. The assessments involve determination of direct relationship to government directives (versus prudent operational decisions) and amortization adjustments. Specific claims have reached as much as $21 million, with negotiated savings resulting from Skelly and Loy's evaluations averaging nearly 55% of the initial claim amount.
